e-Invoice Non-Compliance Penalties
Consequences of not meeting the electronic invoicing obligation
Deadline: October 1, 2026
After this date, all invoices issued outside the PRO e-Invoice system have no legal validity. Penalties for non-compliance range from 300 to 10,000 EUR per violation.
Fine Amounts
The law provides for monetary fines for businesses that do not use the e-Invoice system after the deadline. The amount depends on the company size and severity of the violation.
300 - 1.000 EUR
For small businesses and sole traders. First-time and less severe violations.
1.000 - 10.000 EUR
For medium and large companies. Repeated violations or systematic avoidance.
Fines are per violation, which means each invoice issued outside the system can be considered a separate violation. Repeated violations lead to higher fines.
Loss of Legal Validity
Invoices issued outside the e-Invoice system after October 1, 2026 have no legal validity. This means they cannot be used as proof of a completed transaction, cannot be collected through courts and cannot serve for tax purposes.
Invoice without legal validity = impossible to collect = impossible to deduct VAT = problem for both seller and buyer.
Impact on VAT Deductions
One of the biggest financial risks is losing the right to deduct input VAT. If your supplier does not issue you an e-invoice, you will not be able to deduct the VAT paid on those purchases.
For a company with 100,000 EUR in annual purchases, this means a potential loss of 18,000 EUR (18% VAT) if suppliers do not switch to e-invoice on time.
Impact on Business Partners
Non-compliance does not only affect your business, but also all your business partners:
- -Your buyers will not be able to deduct VAT on your invoices if they are not issued through the e-Invoice system
- -Business partners may stop cooperating with companies that are not compliant
- -In public procurement, e-invoice will be a mandatory requirement for participation
Tax Audit Transparency
The e-Invoice system gives PRO full insight into all transactions in real time. Invoices cannot be changed retroactively, which means tax audits will be faster and more precise. Businesses not in the system will be more easily identified.
How to Stay Compliant
Follow these steps to avoid penalties and problems:
- -Register on the PRO test environment and test the process before the deadline
- -Choose e-invoicing software and obtain a digital certificate (QES or AdES)
- -Inform your suppliers and clients about the switch to e-invoice
- -Coordinate with your accounting firm for a smooth transition
- -Start sending test invoices at least 3 months before the deadline
